Service Disclaimer

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

• Services will be uninterrupted, timely, or error-free
• All security threats will be detected or prevented
• Services will meet all your specific requirements
• Results obtained from service usage will be accurate or reliable

Liability Cap

To the maximum extent permitted by law, Shrkdeep's total liability for any claims arising from or related to these terms or our services shall not exceed the fees paid by you for the services during the six-month period preceding the claim.

Excluded Damages

In no event shall Shrkdeep be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or business opportunities
• Data loss or corruption
• Business interruption or downtime costs
• Reputational damage or loss of goodwill
• Costs of substitute services or products

These limitations apply regardless of the legal theory of liability and even if we have been advised of the possibility of such damages.

You agree to indemnify, defend, and hold harmless Shrkdeep, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with:

8. Termination and Suspension

These terms shall be governed by and construed in accordance with the laws of the State of Missouri, without regard to its conflict of law provisions.

Any disputes arising from these terms shall be resolved through binding arbitration in St. Louis, Missouri, in accordance with the rules of the American Arbitration Association. The arbitration award shall be final and binding, and judgment may be entered upon it in any court having jurisdiction.

Notwithstanding the above, we may seek injunctive or other equitable relief in any court of competent jurisdiction to protect our intellectual property rights or prevent unauthorized use of our services.

10. Miscellaneous Provisions

Entire Agreement

These terms, together with our Privacy Policy and Cookies Policy, constitute the entire agreement between you and Shrkdeep regarding your use of our services and supersede all prior agreements and understandings.

Severability

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Assignment

You may not assign or transfer these terms or your rights hereunder without our prior written consent. We may assign these terms to any affiliate or in connection with a merger, acquisition, or sale of assets.

Waiver

No waiver of any term of these terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these terms shall not constitute a waiver of such right or provision.
